 Micro Enterprise Home Kitchen Operations (MEHKO)

Effective January 1, 2019, the new law gives a city or county "full discretion" to authorize the MEHKOs in their jurisdiction. Under the regulations, until a county or a city authorizes these types of operations, MEHKOs will not be able to be issued a health permit to operate. This bill amends the California Health and Safety Code to establish a “microenterprise home kitchen operation”, referred to as MEHKOs, as a new type of retail food facility that will allow an individual to operate a restaurant in their private residence

Cottage Food Operation

 Allows small-time producers to use appliances in their homes to bake, cook, can, pickle, dry or candy certain low-risk foods for sale. (Example: make BBQ sauce, jar salsa, baked goods, and beef jerky.)

Any person who prepares or packages cottage food must complete a food processor course within three months of becoming registered or permitted and every three years during operation.

By contrast, state laws require all other food producers to process foods in licensed kitchens.
